Referenc~ is made to memorandum from captioned
Committee dated May 14, 1975, and the request of staff member
Mark Gitenstein on June 5, 1975, requesting certain information
pertaining to the "official and confidential" files.
In response to the aforementioned request, we are
attaching a copy of the results of an FBI Inspection Division inquiry.
into the "official and confidential" files matter entitled, "Inquiry
Into Disposition of Files Maintained in the OHice of Former Director
J. Edgar Hoover, " dated 'July 3, 1975.
A list of individuals who were contacted during this
inquiry a.nd have some knowledge relating to this matter has been
prepared and is available for review by staff members of the Senate
Select Committee in FBI space.

Inquiry into Disposition of Files Maintaincd in
tlie Office of Formcr Director J. Edgar lloover
typewrittcn note dated May 5, ID72, prepared by lVII'S. Erma Metcalf,
Mr. lloover's Administrative Assistant, wJlich includes information
indicatin[; that the "Official - Confidential" filcs had been turned ove r
toMr. FeltonMay4, lan, two days after the death of Mr. Hoover.
Mr. Felt has confirmed receipt of these files.
Also located was a "List Of Official - Confidential Files In
Director's Office, " dated October 20, 1!.l71, which wllS prepared by
Mrs. Metcalf. When the "Official - Confidential" files were inventoried
by the Inspection Staff in January, 1!.l75, 'all of the folders listed on the
October 20, 1!.l71, inventory prcpared by Mrs. l'l'letcillf were IJ/lysically
located with the exception of three folders c:lptioned with the names of
three present or former FI3I officials. We have been unable to ac'count
for the disposition of these three folders. It cail be speeuL,ted that these
folders may have contained copies of communications, the originals of
which Were maintained in the normal personnel files of these indiViduals,
and which may have been of particular interest to 1'1'11'. Hoover. The
reason these folders were removed from the "Official - Confidential'~
files could not be determined.
The "Official - Confidential" files listed on the Octobcr 20, 1971,
inventory with the exception of the three folders, mentioned above, continue
to be maintained at FDI Headquarters.
'Since their inception, the maintenance of the "Official - Confidential"
files was the responsibility of either IVfiss Gandy or Mrs. Metcalf.
Mrs. MetcaJ( has stated that these files were "very inactive" and it was
"very vcry seldom" that anyone needed anything' from lhem. Miss Gandy
described these filcs as "not active" and stated they were refel'l'ed to
only on rare occasions. Doth·slated that to their knowledge these files
were never usee! for olher than ,official purposes.

Miss Gandy advised that Mr. Hoover laId her the "Official Confidential"
files should be turned over to whoever was running the
Bureau whcn he left.
She staled that she alone: wns responsible for desi~natill~ material
to be removed from 1\11'. Hoover's office after his death and nothin~ of an
official nature, Bureau files or otherwise J was sent to 1\'11'. Hoover's house

or elsewhere outside the l3ureau. To emphasize this she said, "not
even his badge. "
Accordin~ to Miss Gandy, there were about 35 file cabinet
drawers of 1\11'. Hoover's personal correspondence which were packed in
cardlJoard boxes and moved to his home shorlly afler his death. Afler
her retirementl\1iss Gandy spent about two months reviewing this personal
correspondence for subsequent det;lruction. She reviewed each
item and t;aid she found nothing of an oHiciall3ureau n'ature contained
therein.
In addition to the personal correspondcnce, two 3-drr.wer and
two 2-dral'ler file cabinets con taining folders of material pertaining to
Mr. Hoover's personallJLIsiness affairs were removed frolll his office
and moved to the recreation room in the basement of his home. The
material in these file cabinets included such things as copies of every
income tax relurn filed by NIl'. Hoover and separale folders on each of
his stock and oil well investments. These file cabinets, with their COI.1tcnts,
are still at Mr. lJoover's residence, plus two other file cabinets
containin~ similar material relative to the personal business affairs of
Clyde A. Tolson, which I'.'cre also brougllt to Mr. Hoover's residence
shortly afler 1\11'. Hoover's death.
Mr. John P. Mohr slated, "Thcre wcre never any l3Ul1~ au files
taken to Mr. lloover l s house after Hoover's death." He participated
in an inventory for tax purposes of the entire contcnts of Mr. Hoover's
home in July, l!J72, and pointed out that if there had been such files
there he would have seen them and he observed none.
During this inquiry we interviewed over 20 persons who had
been at Mr. 1l0oYf:r's house within a short time after his death. None
of the persons could furnish any 'informati<Hl indicatin~ the presence of
any ofIiciall3ureau files at his residence.
It WaS the recollection of a l3ure:lu trucl, driver, Ulat
shorlly aftcr Mr. lioovL~r's death ~ delivered a total of 20 to 25 file

in the basement. He said these cabinets were full and lhat during lhe
movin~ a drawer came open on one of the cabinets and he observed light
colored folders inside wilh the contents of each folder roughly one inch
thick. lie is unable lo say where these file cabinels came from as lhey
were already on his truck when he received his inslruclions to lake
them to 1\11'. Hoover's residence. Inasmuch as no other persons interviewed
could corroborale that such a la...r~e number of file cabinets were
delivered to 1\11'. Hool'er's house ,:. "was reinterl'fewed on two further
occasions in an effort to develop aliything which would assist in subst,
1.ntialing 01' disprovinf: lhal lhis occ'urred. At this point Smith remains
adamant that he did, in fact, bring 20 to 25 fi!~ cabinets to the hou~e. '
Of more than 20 persons interviewed who were at Mr. Hoover's
house subsequent to Ill," death none e~Qr recaLL seeing such a large numbe"
of file cabinets. -- the c!Jxetaker at Mr. Hoover's
house for many years'~andY/ ' , his cook and maid, who
were at the house daily areemphatic that th~re were never more than,
six file cabinets in the recreation room of lVIr. Hoover',s house at allY
time and that Smith has to be wrong.

It is the feeling of those who have interviewed 'that he
believes he actually did deliver as m'any file cabinets as'he has indicated,
but he is in fact confusing' a number of instances. We ha I'e determined
that a large number of cardboard boxes containing Mr. Hoover's personal
effects and memorabilia were taken to 1'1'11'. Hoover's J:llsidence
from his office within about one weel, after his death. " l)arlieipated
on a number of occasions in hauling this material to the 'hOlise and into
the recreation room where most of it was stored. We have also determined
tha t he was present :wd assisted in lllol'ing sOllle of the six HIe
cabinets, previollsly mentioncd, ,and have determined Lhat at Llle lime they
were moved somo of these cabinets did contain light colored folders, the
con tents of which al'e approximatc ly one inch thiclt..
Of thc ncarly 40 flersons interviewcd IIh 0 wCrc involved in moving
material, none has any recollection of participating: in the movement of
20 to 25 file cabinets to Il'lr. HOl)\'~'r's residcnce or of seein~ such a
number there. Wc C;II\ only conclude that while honest in his belief
Smith has a jumbled recollection of the facts due La Lhe passage of over
three years since 1\11'. Hoover's deaUl.

Jliquiry into Disposition of Files Maintained in
the Office of Former Director H. Edgar Hoover
Part of the request of the Attorney General was to determine
whc!her any official files had been removed from I\1r. Hoover's residence
following; the death of l\1r. Tolson. Inasmuch as our inquiry has
Shown that there were no such files at Mr. Hoover's home it follows
that none were removed aHer 1\11'. Tolson's death. However, we did
make inquiry into the movement of anylhin~ which might be construed
to be files from Mr. Hoover's house after Mr. Tolson's death on
April 14, 1975, and f01Uld no such evidence.
It was determined, howevei·, that sho,rtly after Mr. Tolson's
death a number of empty cardboard boxes were taken to 1\11'. IIo~er's
residence by a Bureau employee. These boxes were utilized byl..,
~ the caretaker, to pacle pictures which had been laying loose
in the attic and also to dispose of some old canned goods. The boxes
_JIillldhe canned goods we1'0 placed in the garbage outside.
In connection with the removal of material from 1\11". Hoovel"s
home, it was determined that during the period of approximately the
middle of l\Iay to the middle of July, 1972, cardboard boxes'containing
the personal correspondence of Mr. Hoover, which had been reviewed
. by Miss Gandy at his residence, were picked up at the house on several
occasiolls and destroyed by persollnel of the Washington Field Office.
·Also in connection with the removal of material from 1\11'. Hoover's
house, it was determined that on two occasions in 1974 numerous cardboard
boxes conbining books were removed from Mr. Hoover's home,
loaded onto trucks and delivered to the library at the FnI Academy,
Quantico, Virginia. These bool{s had been purchased by the J. Edgar
Hoover Fowldation and donatee; to the library.

In response to an inquiry by the Bureau Of December 5~
1950, as to the progress made by tile Depart~ent in revieWing
our Security Index cases, ~eputy Attorney General Peyton Ford
advised on J)ecember 7, 1950, that "in the event Of occu,rence
Of an emergency which requires the use of the detention program,
all Of the persons nO:D or hereafter included by the Bureau on
the Securlty Index should be considered subjects for imm.ediate
apprehension thus resolving any possible dOUbtful cases in favor

At the concluding session of the U. S. Attorneys'

provisions of the Internal Security .lci of 1950. At that t~me
he pointed out that the Act is unwie1d1y and unworkable.

that the standards be ing drawn up by the Departl,lent at that
time for persons to be a.:Jprehended in an er,zergency were to
be based principally on the Internal Security Act of 1950 but
that leeway had been added to the standards specified by the
